Terms of Service for participation in the educational events of the Q&A Academy

1. Organiser

1.1. The organiser, the company Quanda International s.r.o., with its registered office at Národních hrdinů 44, Dolní Počernice, 190 12 Praha 9, company ID: 02285665, registered at the Municipal Court in Prague, Section C, Insert 217649 (hereinafter the „Organiser") organises professional lectures, seminars, workshops and conferences (hereinafter „In-person events") and online courses and webinars (hereinafter „Online courses").

1.2. The contractual relationship between the Organiser and a Participant of In-person events or Online courses is governed by these Terms of Service and by the relevant legal regulations, in particular Act No. 89/2012 Coll., the Civil Code.

2. Participant of the Event

2.1. A participant of the event is a natural person who registers or reserves a place at an In-person event or Online course organised by the Organiser on the website www.quanda.com. (hereinafter the „Participant")

3. Registration and reservation of a place

3.1. A reservation of a place at an In-person event can be made via the Organiser's website at www.quanda.com using the online form for the individual In-person events.

3.2. Participants of Online courses are obliged to register via the registration form available on the Organiser's website for the individual Online courses. Truthful and error-free completion of the data is necessary to complete the registration, which is completed by clicking on the verification link in the e-mail sent after registration to the e-mail address stated in the registration form. Registration of a Participant is free of charge. The Participant is entitled to register only under their own name and to enter, upon registration, only data about their own person.

3.3. The contractual relationship between the Organiser and the Participant arises:

  1. by the Organiser confirming the reservation for the In-person event. This confirmation of participation takes place by sending an e-mail with confirmation of the reservation,
  2. by clicking on the verification link in the e-mail sent by the Organiser after the registration of the Participant of an Online course to the e-mail stated upon registration and by activating the account.

4. Price and payment terms

4.1. The Organiser, among other things, provides some In-person events and Online courses free of charge. These are In-person events or Online courses which are stated to be free of charge. Neither the Participants nor any other third party acquires any legal claim to these free In-person events and Online courses, and the Organiser reserves the right, at any time, unilaterally and without stating a reason, to limit the number of places, to restrict or completely cancel the availability of the provision of these free In-person events or free Online courses.

4.2. In the case of paid In-person events or Online courses, their provision is conditional upon payment of the price stated within the offer of In-person events or Online courses on the Organiser's website at www.quanda.com

4.3. The price of an In-person event or Online course is stated as final, including taxes and fees, always for the relevant In-person event or Online course.

4.4. Payment for the paid In-person events or Online courses can be made cashlessly in the following ways:

  1. by payment card online (Online courses only),
  2. by online payment (Online courses only),
  3. by transfer to a bank account.

4.5. In the case of a paid In-person event, the price must be paid no later than 1 day before the date of the In-person event. The price is deemed to have been paid at the moment the payment is credited to the Organiser's account.

4.6. After payment of the price, a tax document will be sent to the participant at the e-mail stated in the reservation or registration.

4.7. In the case of payment of the fee and subsequent cancellation before the date of the In-person event, part of the paid fee is refunded to the Participant according to the rules below:

  1. in the case of cancellation more than 10 working days before the date of the In-person event, 100% of the paid fee is refunded,
  2. in the case of cancellation at least 3 working days before the date of the In-person event, 50% of the fee is refunded,
  3. in the case of cancellation fewer than 3 working days before the date of the In-person event, the paid fee is not refunded.

5. Complaints and cancellation

5.1. The Organiser accepts any complaints and cancellations primarily at the e-mail address: support@onquanda.com

6. Rights and obligations of participants of an In-person event

6.1. Participants are obliged not to disrupt the course of the event. The Participant acknowledges that if they arrive at the event under the influence of alcohol, narcotic or psychotropic substances, they will be immediately excluded from the event by the event's organiser without the right to financial compensation.

6.2. We ask all participants to arrive at the event at least 15 minutes before the planned start time of the event, which is stated in the invitation that is sent by the Organiser before the date of the event to the e-mail stated in the reservation of a place at the event.

7. Cancellation of an In-person event

7.1. In the event of cancellation of the event, the Participant is informed at least 3 days in advance, to the e-mail stated in the reservation. In such a case, the already paid price for the event is refunded to the participant in full, or another date of the event is offered.

8. Withdrawal from the contract, money-back guarantee

8.1. By concluding the contract, the Participant of Online courses expressly agrees that the Organiser makes the Online course available to the Participant before the expiry of the period for withdrawal from the contract. The making available of the Online course by the Organiser takes place at the moment when the price of the Online course is credited to the Organiser's account or to the account of the payment gateway. If the Online course is made available to the Participant in this way within the period for withdrawal from the contract, the User does not have the right to withdraw from the contract in this way.

8.2. Where the cases under Article 8.1 do not apply, the Participant has the right to withdraw from the contract without stating a reason within a period of 14 days from the day following the day of conclusion of the contract. For the purposes of exercising the right to withdraw from the contract, the Participant must inform the Organiser of their withdrawal from the contract (without having to state a reason) at the e-mail support@onquanda.com. In the e-mail sent, the Participant shall state their e-mail address with which they registered or which they used for the reservation, the bank account number for the refund of the payment, and shall attach the tax document from which it will be evident which In-person event or Online course the withdrawal from the contract concerns. If the Participant does not have the tax document available, it can be requested at the e-mail address support@onquanda.com.

8.3. In order to observe the period for withdrawal from the contract, it is sufficient to send the withdrawal from the contract before the expiry of the relevant 14-day period for withdrawal from the contract. In the case of withdrawal from the contract, the Organiser will refund the amount without undue delay, no later than within 14 days from the day on which it is delivered the notice of withdrawal from the contract received from the Participant. The refund of the payment will be carried out by the Organiser cashlessly by sending the funds to the Participant's account.

9. Protection of intellectual property

9.1. All content received by a participant of an In-person event or made available via an Online course is protected in accordance with the legal regulations relating to copyright and other intellectual property rights, and its exclusive holder is the Organiser, or the relevant licensors. By handing over or making available this content, the Participants acquire no entitlement in connection with the capturing, displaying, reproduction and dissemination of the likeness, image, visual images and visual and sound recordings relating to the person (persons) appearing within the digital content made available within the Online courses, nor of their first name, surname, academic title, including their processing and inclusion in an audiovisual work or for other marketing purposes. Any such use is possible only with the express consent of the authorised persons or in accordance with the applicable legal regulations.

9.2. The Participant may not use this content or any part of it other than for their own needs. In particular, it is prohibited for the Participant to use this content or any part of it in the form of dissemination and copying or further technical processing without the demonstrable consent of the Organiser.

10. Protection of personal data

10.1. Information on the processing and handling of personal data by the Organiser, in particular the personal data of participants, is contained in the document Privacy Policy, which is available on the service's website. As part of the registration process, the participant has confirmed that they have familiarised themselves with this document.
